Attorney Letter for Late or Non-Payment
If you have been contacted by an attorney for any issues relating to money owed (from the view point of the association) or for not paying your dues or for paying them late, or about a violation that was not corrected at the time the letter was sent - here is what you have to do. ¨ You have to call the attorney. Management personnel nor the Board can help you. ¨ Once an account is turned over to the association’s attorney, you must communicate directly with the attorney. ¨ Management personnel nor the Board are permitted to speak with you, research your account, and discuss hardships or any other circumstances. ¨ There are legal reasons requiring that you contact the attorney directly to handle your affairs. ¨ When you call the attorney, to be effective, be professional, polite and contain any annoyance or anger. Counsel didn’t create the problems that caused your situation. They are merely the messenger. ¨ Be straightforward when you speak with Counsel. There are times when we all forget important things or have to deal with hardships or just get distracted by life. ¨ Settle the matter and be done with it or offer a payment plan, but please call the attorney and resolve it. ¨ In closing, we are so sorry that we are unable to comfort you or walk you through a resolution with counsel, but once a matter reaches this stage we are not permitted to discuss this matter with you or assist you in any way – you must contact the association’s attorney.
